(2) Any differing, conflicting or supplementary terms and conditions of the user shall not become part of the contract unless their validity is expressly agreed to in writing.

2. Scope of Services and Video Consultation (1) Ortungstechnik Nachbaur GmbH provides information on its website as well as the possibility to conduct video calls / online consultations (e.g. for initial assessment of leaks, moisture damage or metrological questions).

(2) Online or video consultations serve as an initial visual and verbal assessment. They do not replace a comprehensive damage analysis or on-site measurement and inspection, if such an inspection is technically necessary.

(3) The operator reserves the right to adapt, expand or restrict the service offering at any time.

3. Technical requirements and availability (1) The user is responsible for providing the technical requirements necessary for the use of the video call (suitable terminal device, functioning camera and microphone, stable internet connection, current browser) at his own expense.

(2) Nachbaur GmbH strives to ensure high availability of its online services, but does not guarantee uninterrupted technical accessibility or error-free transmission quality.

4. User’s Obligations (1) The user undertakes to provide truthful information when using the services.

(2) The user is expressly prohibited from making any image or sound recordings (e.g. screenshots, screen recordings) during the video call without the prior written consent of Ortungstechnik Nachbaur GmbH.

(3) Abusive use (e.g. transmission of illegal content, disruption of the systems) is prohibited and will result in the immediate termination of the session and, if necessary, legal action.

5. Copyright and Intellectual Property Rights All content, logos, graphics, texts, and the design provided on this website are protected by copyright. Any use, reproduction, or distribution beyond the scope of the contractually granted rights requires the express written consent of the operator.

6. Limitation of Liability (1) Ortungstechnik Nachbaur GmbH shall only be liable for damages – regardless of the legal basis – in cases of intent and gross negligence. For slight negligence, the operator shall only be liable in cases of injury to life, body or health, as well as in cases of breach of essential contractual obligations (cardinal obligations).

(2) No guarantee is given for the completeness of the advice given remotely via video call, as the assessment of hidden damage (such as individual cases of pipe breakage) is subject to limitations due to the camera transmission.

7. Data Protection The processing of personal data is carried out strictly in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG). Detailed information can be found in our [Privacy Policy].

8. Applicable Law and Jurisdiction (1) Austrian law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-laws rules of private international law.

(2) For merchants or corporate customers, the court with subject-matter jurisdiction in Austria for the registered office of Ortungstechnik Nachbaur GmbH shall be the exclusive place of jurisdiction. For consumers, the statutory places of jurisdiction shall apply.
